Terms & Conditions
Any booking made with NativeToursJamaica will be governed by and subject to these Terms & Conditions. Unless otherwise stated, purchases made through Nativetoursjamaica.com are subject to these Terms & Conditions; in all booking arrangements, the person making the booking shall be deemed to have accepted these conditions on behalf of the persons named in the booking.
A fixed rate is charged for group of 1 to 4 people; for 5 and over a per person rate is charged. The rate for 1 – 4 people applies at the time of booking only. Any addition after the booking is complete will attract an additional fee and the appropriate fees will be applied at the time of amendment.
Price quotations are subject to change without notice. Tips/gratuities to tour guides, drivers and other service providers are not included in our prices, and although generally considered appropriate, this is strictly a personal decision.
2. Information Provided by You
You are responsible for providing accurate, timely and complete information in connection with Your registration for and use of the Site. NativeToursJamaica is not responsible for any claims relating to any inaccurate, untimely or incomplete information provided to us by You.
NativeToursJamaica uses a third party service to process your credit card information, therefore we have no access to your credit card information. For further information regarding that service, please contact NativeToursJamaica credit card processing company. www.PayPal.com
3. Confirmation/Voucher issue
NativeToursJamaica will send a confirmation/voucher by e-mail within 24-72hrs after payment is received. This voucher has to be printed as a proof of purchase and will be presented to our representative at the time of provision of service. All information regarding the travelers should be correctly given at the time of booking. NativeToursJamaica cannot be held responsible for any problem that may happen if you don’t receive or read carefully your confirmation/voucher. We recommend checking your junk mail box as your email provider may recognize us as spam. In case you have not received your voucher, it is your responsibility to notify NativeToursJamaica prior to your departure.
4. Cancellation & Refund Policy
Any cancellation by You must be made by telephone or email and acknowledged by NativeToursJamaica.
For Airport Transfers: a full refund will be given if cancelled before 24 hours prior to the provision of service. There will be no refund for cancellation 24 hours or less. If you decide, for any reason whatsoever, not to participate in all or part of your scheduled transfer, NativeToursJamaica will not be required to make any refunds.
For Tours and Excursions: Amount paid less upfront costs. These upfront costs may represent expenses for tickets or deposits to secure tour. If a tour is cancelled due to weather or the ship’s inability to get into port, it is your responsibility to contact us for a refund. If you decide, for any reason whatsoever, not to participate in all or part of your scheduled tour, NativeToursJamaica will not be required to make any refunds. Refunds are made to the booking party only. If payment was made by and through a travel agency, the refund will be made to that entity.
NativeToursJamaica reserves the right to cancel scheduled tours, transfers, attractions and activities at any time in the event of insufficient sales, hazardous weather conditions or unforeseen operational problems. In the event that NativeToursJamaica cancels the tour, or does not deliver it as promised, You may choose between a rescheduling of the tour OR a full refund of all monies paid or a credit towards an alternative tour. If you choose to accept a credit, the difference in the cost of the alternative tour will be refunded by NativeToursJamaica or paid by You, as applicable.
5. Modification of the Terms of this Agreement
Native Tours Jamaica reserves the right to make changes to this Agreement from time to time. Native Tours Jamaica shall provide notice to You of any substantive and/or material changes to this Agreement or any policies posted on the Site by posting such changes on the Site.
NativeToursJamaica connects You with tours that are offered by third party attraction owners. We do this through our website, Nativetoursjamaica.com (“Site”), which provides ground transportation and local tour guides.
You understand and expressly agree that the tours offered on this site are independent of Native Tours Jamaica and therefore we do not control the quality, timing, legality or any other aspect whatsoever of the services actually delivered by these attraction owners, nor of the integrity, responsibility or any of the actions whatsoever of these attraction owners.
6. Limitation of Liability
Under no circumstances will NativeToursJamaica be liable to You for any indirect, incidental, consequential, special or exemplary damages arising from any provision of this Agreement or from the provision of any tours or other services purchased from the Site. Furthermore, the TOTAL liability of NativeToursJamaica arising with respect to this Agreement and the Site shall in no event exceed the total amounts paid by You to NativeToursJamaica under this Agreement.
7. Disclaimer of Warranties
YOU EXPRESSLY AGREE THAT THE USE OF THIS SITE IS AT YOUR SOLE RISK. NativeToursJamaica DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE; NOR DO WE MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SITE, OR AS TO THE ACCURACY, RELIABILITY OR CONTENT OF ANY INFORMATION, SERVICE OR MERCHANDISE PROVIDED THROUGH THE SITE. THE SITE IS PROVIDED ON AN “AS IS” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTIBILITY OR FITNESS FOR A PARTICULAR PURPOSE.
